Terms of service
These terms apply to all bookings and supply of goods or services by Zelquarixs. Confirmation of a booking requires written acceptance of a quote and payment of any required deposit. Services include design, supply, delivery, installation and collection if agreed.
- Quotes are valid for 14 days unless otherwise stated.
- Deposits secure dates and are typically non-refundable except where required by law.
- Final guest numbers and design requests must be confirmed *** later than 14 days before the event, unless stated otherwise.
Cancellation, deposits and refunds
Cancellation terms differ for services and goods. Where applicable and permitted under New Zealand law:
- Deposits: A deposit (specified in your quote) is required to secure a booking. Deposits are treated as part payment for services and may be forfeited on cancellation.
- Cancellation by client: If you cancel, we will endeavour to mitigate losses and may offer partial refunds depending on timing and costs already incurred.
- Cancellation by Zelquarixs: We reserve the right to cancel for safety, supply failure or force majeure; a full refund will be provided if we cancel your confirmed booking.
Note: Under the Consumer Guarantees Act a consumer may have additional rights where goods supplied are not of acceptable quality.
Delivery, setup and hired items
Delivery and setup terms will be included in your quote. Hired items (stands, vases, arches) remain the property of Zelquarixs and must be returned in the condition supplied. Damage or loss may incur replacement or repair charges.
We reserve the right to substitute flowers or materials due to seasonal availability; substitutions will be of equal or greater value.
Liability, insurance and risk
Zelquarixs maintains insurance for business operations. Liability for direct loss arising from our negligence is limited to the amount paid for the relevant goods or services. We are not liable for consequential loss unless required by law.
Clients are responsible for site access and safety. Where event sites present unusual risks, we may refuse to proceed until hazards are mitigated.
Consumer rights & dispute resolution (New Zealand)
Consumers in New Zealand have statutory rights under the Consumer Guarantees Act and protection from misleading conduct under the Fair Trading Act. If you believe your consumer rights have been breached:

- We will acknowledge and propose a remedy within a reasonable timeframe (typically 7 business days).
- If unresolved, consumers may apply to the Disputes Tribunal or contact Consumer Protection services at MBIE for guidance.
Governing law: This agreement is governed by the laws of New Zealand and subject to the exclusive jurisdiction of New Zealand courts.

All creative designs, images, website content and marketing material provided by Zelquarixs are protected by copyright. Use or reproduction requires prior written permission.
Clients may request permission to use images for personal sharing; commercial use requires written consent.
